1. Agreement to Terms

By accessing and using Gritworks Collective LLC (the "Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

2. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Gritworks Collective LLC and its licensors. Our branding, methodologies, and questionnaire tools may not be used in connection with any product or service without the prior written consent of Gritworks Collective LLC.

3. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

Age Requirement: You must be at least 18 years of age to create an account and use the Service. By creating an account, you represent and warrant that you are at least 18 years old.

4. Program Pacing & 18-Hour Cooldown

To ensure behavioral integration rather than passive consumption, the platform enforces an 18-hour cooldown between missions. Once you complete a mission, the next mission will unlock after 18 hours. This is a non-negotiable feature of the program design and applies to all paid tiers.

5. Tiered Refund Guarantees

DIY Sprints ($99): The 15-Day Proof-of-Work Guarantee. This tier is protected by a conditional 15-day Proof-of-Work window. If you actually put in the reps (completing the first 7 missions within 15 days) and find no value in the system, we will issue a full refund. As a parting commitment to your growth, we'll even purchase and ship you an industry-leading book tailored to your program track to ensure you keep moving forward. We do the work, or we part ways as professionals. If your mission logs are empty or spammed just to bypass reading, the refund is void.

Advisor-Guided Sprints ($497): The Anti-Guarantee. There are strictly no refunds for the Advisor-Guided tier. If you are already looking for an exit door before you begin the work, this is not the room for you. Keep your money. This high-accountability tier relies on absolute, "burn the ships" commitment.

6. AI-Generated Content

The Service includes AI-powered features (including "gritBOT" and mission analysis tools) that generate coaching suggestions using Google's Gemini API. By using these features, you acknowledge and agree to the following:

  • Not Professional Advice: AI-generated responses are educational coaching suggestions only. They do not constitute medical, psychological, legal, or financial advice.
  • Accuracy Not Guaranteed: AI responses may contain inaccuracies, incomplete information, or suggestions that are not appropriate for your specific situation. You are solely responsible for evaluating and acting on any AI-generated content.
  • No Liability: Gritworks Collective LLC assumes no liability for any decisions, actions, or outcomes resulting from your reliance on AI-generated content.
  • Data Handling: Your messages to the AI advisor are processed by Google's Gemini API. No personally identifiable information is intentionally included in AI requests. See our Privacy Policy for full details.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

8. Service Availability & Modification

Access to purchased content remains available for as long as the platform is actively maintained. Gritworks Collective LLC reserves the right to modify, suspend, or discontinue any part of the Service — including specific programs, missions, or features — at any time, with or without notice. In the event of a full platform discontinuation, Gritworks Collective will provide a minimum of 90 days' advance notice to active users via email. No refunds will be issued for previously purchased access in the event of a discontinuation.

9. Advisor-Guided Tier

The Advisor-Guided enrollment tier ("$497 tier") includes access to asynchronous messaging with a Gritworks Advisor and one scheduled 50-minute live session. By enrolling in this tier, you acknowledge and agree to the following:

  • Non-Clinical Relationship: Your Advisor is not a licensed therapist, psychologist, or medical professional. All communication is strictly educational advising and resilience coaching — not clinical therapy, counseling, or medical treatment.
  • Response Timeframes: Asynchronous messages are addressed within 3–5 business days. Response times are not guaranteed during holidays or advisor absences.
  • Session Scheduling: Live sessions must be scheduled within the enrollment period. Unused sessions do not roll over or convert to credit.
  • Appropriate Use: The advisor messaging system is intended for program-related coaching questions. It is not an emergency service. If you are in crisis, contact local emergency services or a licensed mental health professional.

10. Partner Invite System

Certain programs (including Partnering) allow enrolled users to invite a partner to create a linked account. By using the Partner Invite feature, both parties agree to the following:

  • Consent: The inviting user represents that they have obtained the invitee's consent to receive an invitation and to have their email address submitted to Gritworks Collective LLC.
  • Linked Accounts: Partner accounts are linked for the purpose of shared program context (e.g., joint mission recommendations). Each account holder retains independent control of their own data and account settings.
  • Data Scope: Linking a partner account does not grant either party access to the other's private responses, questionnaire scores, or personal data. Only program-level context is shared.
  • Invitation Removal: Either party may dissolve the linked account relationship at any time via their profile settings.

11. Accountability Partner

Certain programs allow enrolled users to designate an Accountability Partner ("AP") who will receive occasional SMS milestone texts. By using this feature, you agree to the following:

  • Consent: You represent that you have obtained your AP's consent to receive text messages on your behalf before submitting their phone number.
  • Message Scope: AP texts are limited to program milestone prompts (capped at 1–2 per week). APs do not receive access to your account, responses, or personal data.
  • Opt-Out: Your AP may opt out at any time by replying STOP to any message. You may remove your AP at any time via your profile settings.
  • Liability: Gritworks Collective LLC is not responsible for any interpersonal consequences arising from AP communications.

12. Medical and Educational Advising Disclaimer

Gritworks Collective LLC provides resilience advising, educational frameworks, and self-guided relational tools (including the Co-Parenting Alignment Matrix). The Service is strictly educational and does not constitute medical, psychological, psychiatric, or therapeutic advice, diagnosis, or treatment. Our tools are not a substitute for professional clinical care. If you are experiencing a mental health emergency, experiencing domestic violence, or suspect child abuse, contact local crisis services immediately.

13. Limitation of Liability and "As-Is" Warranty

The Service, including all coaching materials, interactive tools, and frameworks, is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. To the maximum extent permitted by applicable law, in no event shall Gritworks Collective LLC, its founders, affiliates, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, emotional distress, family disputes, loss of custody, or financial losses resulting from your access to or use of (or inability to access or use) the Service or any content provided therein. Your reliance on any information provided by the Service is solely at your own risk.

14. Indemnification

You agree to defend, indemnify, and hold harmless Gritworks Collective LLC from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service. This includes, but is not limited to, any claims brought by third parties (including co-parents or family members) resulting from your application of our frameworks or advice.

15. Referral Program

Gritworks Collective offers a referral program that provides discount codes to existing users. By participating, you agree that:

  • Referral codes are limited to one use per unique individual.
  • Gritworks Collective reserves the right to revoke or deactivate any referral code at any time, for any reason, including suspected abuse.
  • Referral discounts cannot be combined with other promotions unless explicitly stated.
  • Self-referrals (using your own code to create a second account) are prohibited and may result in account termination.

16. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

17. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at our sole discretion.

18. Data Retention & Coaching Metrics

Gritworks Collective uses internal coaching metrics (numeric scores) solely for content personalization and curriculum routing. These metrics are not clinical assessments, evaluations of client behavior, or client records. Granular coaching metrics are automatically anonymized and de-identified after 90 days. After this period, only aggregate, non-attributable composite scores are retained in your account. De-identified, anonymous data may be retained indefinitely for program improvement and research purposes; this data contains no personally identifiable information and cannot be linked to any individual user.

19. Legal Process & Records Retrieval Fee

Gritworks Collective LLC is not a healthcare provider and does not maintain clinical records. In the event that Gritworks Collective LLC receives a subpoena, court order, or other legal process requesting user data, Gritworks reserves the right to charge a records retrieval and compliance fee of $250 per hour (one-hour minimum) for the time and expense required to respond. This fee must be tendered in advance of any document production. Gritworks Collective LLC will comply with valid legal process to the extent required by law, but will only produce data that exists at the time of the request.
